In Dr. Öztürk’s book, qualification, which is regarded as one of the fundamental problems of private international law, is examined in the context of international arbitration. The study explores whether traditional qualification theories developed in conflict of laws can be applied by arbitral tribunals which do not have a lex fori. It further analyses the governing law of qualification and examines the importance and consequences of the qualification decisions made by arbitral tribunals at different stages of the arbitration proceedings. The book identifies and systematizes the issues that are subject to qualification in international arbitration.
